The Jammu Kashmir high court on Tuesday directed the state government to file a status report regarding the first information reports (FIR) in the case of custodial disappearance of a youngster in Lolab who was allegedly detained by the army.
The single bench headed by Justice Mohammad Yaqoob Mir directed the state counsel, BA Dar to submit an investigation report of FIR Nos 62 and 63 of 2017 registered at Lalpora police Station in Lolab of district Kupwara to ascertain the facts regarding disappearance of Manzoor Ahmed Khan and allegations regarding third degree torture suffered by Nasrullah Khan at the hands of Army.
On previous hearing, the court issued a notice to J&K government and army to file response regarding Khan who was allegedly missing in the custody of Army.
Tahir Shamsi, assistant solicitor general denied that army is involved in Manzoor Ahmed's custodial disappearance.
Advocate Nasir Qadri who represents the petitioner said,"Manzoor was taken into custody by 27 RR camp on May 31, 2017. Since then he was not released. Police station Lalpora had filed a case under FIR No 63/2017 under section 364, 343 RPC."
"Another local, Nasrullah Khan was also detained on the same day. Later on, he was released with third degree torture. His kidneys had suffered huge damage and was admitted in SKIMS hospital for treatment", he said.
In this regard, Police station Lalpora has filed FIR No 62/2017 under section 307,342 and 323 RPC.
On 31 August, Manzoor went to Bandipora via Devar- Aloosa Road for livestock marketing along with his uncle and paternal aunt.
The petition reads, "While making entry, he was called by Major Nishint Gupta of 27 RR Trimuk Post inside the camp. His uncle and paternal aunt were waiting for two hours outside the camp."
In the evening time, his family who was waiting outside the camp was told by army officials that Manzoor was released from another gate and was no more with them. However, till now he has not been traced.
Under section 161, 162 Cr Pc, the statement of Manzoor's uncle and paternal aunt have also been recorded by police.
